-- LAWSUIT PREVAILS, JUSTICE MUST RELEASE NAMES OF DETAINEES --
Since December 5, 2001, The Multiracial Activist has been a plaintiff in a case involving post-9/11 arrests and detentions by the Department of Justice.
A freedom of information act request was filed late last fall, which TMA signed onto in November, and was illegally rejected by Justice. A group of civil liberties organizations and publications, led by the Center for National Securities Studies sued for release of the names. The case was just decided at about 4:10 pm. We just won and Justice will have 15 days to release the names.
Secret detentions, denial of due process, lack of counsel and denial of contact with family members has become a major human rights issue for those individuals secretly detained since September 11. The present Administration feels that it has almost unfettered right to do as it pleases as long as it claims the action is anti-terrorism related. This decision is a well-deserved spanking for an Administration that is simply out of control. The names of all detainees must be released, except for those approved by Judge Kessler on a case-by-case basis. Use of secret detentions, midnight deportations and denial of due process is not the way our Constitutional Republic is supposed to operate. If we are to maintain any moral high ground in the eyes of other nations and ourselves, we cannot resort to the fascist tactics of totalitarian regimes. Our freedom, our integrity and our future security demand nothing less.
